This website is operated by Mission Workshop. Throughout these Terms of Service, the terms "Mission Workshop," "we," "us," and "our" refer to Mission Workshop.
These Terms of Service ("Terms") govern your access to and use of our website, online store, mobile services, and other services that link to these Terms (collectively, the "Service"), including your purchase of products through the Service.
Please read these Terms carefully before accessing or using the Service. By accessing or using the Service, creating an account, or placing an order, you agree to be bound by these Terms and by any policies incorporated into these Terms by reference. If you do not agree to these Terms, you may not use the Service.
Our online store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to offer products and services to you.
SECTION 1. ELIGIBILITY AND ONLINE STORE TERMS
By using the Service, you represent that you are at least the age of majority in your state, province, or other jurisdiction of residence, or that you are the age of majority and have given permission for any minor dependents under your supervision to use the Service.
You may use the Service only for lawful purposes and in accordance with these Terms. You may not use our products or the Service for any illegal or unauthorized purpose or violate any applicable law in connection with your use of the Service.
You must not transmit viruses, worms, malware, destructive code, or other material intended to interfere with or compromise the operation or security of the Service.
We may suspend or terminate your access to the Service if you violate these Terms.
SECTION 2. PRODUCTS, AVAILABILITY, AND PRICING
Certain products may be available exclusively through our online store and may be offered in limited quantities.
We make reasonable efforts to accurately display and describe our products, including their colors, materials, dimensions, specifications, and other characteristics. However, the appearance of products may vary depending on your device, display settings, lighting, manufacturing variations, and other factors.
Product descriptions, availability, and pricing may be changed at any time without notice. We reserve the right to discontinue any product at any time.
We may limit the sale or quantity of products available to any person, household, geographic region, or jurisdiction where permitted by law.
All offers are void where prohibited.
Unless otherwise stated, prices displayed on the Service do not necessarily include applicable taxes, duties, customs charges, or shipping costs. Any applicable charges will be disclosed as required during the purchasing process.
SECTION 3. ORDERS AND ORDER ACCEPTANCE
When you submit an order, you are making an offer to purchase the products in that order.
An order confirmation or other automated communication acknowledging receipt of your order does not necessarily constitute our acceptance of the order.
We reserve the right to accept, reject, limit, or cancel any order, in whole or in part, subject to applicable law. Reasons may include product availability, suspected fraud or unauthorized activity, errors in product or pricing information, restrictions on resale, or other circumstances affecting our ability to fulfill the order.
We may limit or cancel quantities purchased per person, household, account, payment method, billing address, shipping address, or order.
We may also limit or prohibit orders that, in our reasonable judgment, appear to be placed by unauthorized dealers, resellers, or distributors.
If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method, subject to applicable law and payment processor requirements.
We may contact you using the email address, telephone number, billing information, or other contact information you provide in connection with an order.
SECTION 4. BILLING AND ACCOUNT INFORMATION
You agree to provide current, complete, and accurate purchase, billing, shipping, and account information.
You agree to promptly update your information as necessary so that we can complete transactions and contact you regarding your purchases or account.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account to the extent permitted by law.
You agree to notify us promptly if you believe your account or credentials have been accessed or used without authorization.
SECTION 5. SHIPPING AND DELIVERY
Shipping options, estimated delivery times, costs, and other applicable fulfillment information are described during checkout or in our Shipping Policy.
Delivery dates and transit times are estimates unless expressly stated otherwise. Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, customs processing, transportation disruptions, incorrect delivery information, and other events.
Any shipping restrictions, international shipping terms, customs obligations, duties, taxes, and related charges will be governed by the information provided during checkout and our Shipping Policy.
Our Shipping Policy, as updated from time to time, is incorporated into these Terms by reference.
SECTION 6. RETURNS, EXCHANGES, AND REFUNDS
Returns, exchanges, refunds, final sale items, and related conditions are governed by our Return Policy.

Nothing in these Terms or our Return Policy limits any rights or remedies that cannot lawfully be waived under applicable consumer protection law.

SECTION 7. MOBILE MESSAGE SERVICE
The Mission Workshop mobile message service (the "Mobile Service") is operated by Mission Workshop.
By enrolling in or using the Mobile Service, you agree to the terms in this Section.
By consenting to receive SMS or text messages from Mission Workshop, you agree to receive recurring messages from or on behalf of Mission Workshop at the mobile number you provide. Messages may be sent using automated technology where permitted by law.
Service related messages may include order updates, account information, alerts, and other transactional or informational communications. Marketing messages may include product announcements, promotions, special offers, cart reminders, and other marketing communications.
Consent to receive marketing text messages is not a condition of purchasing any goods or services from Mission Workshop.
Message frequency varies. Message and data rates may apply. You are responsible for charges imposed by your wireless provider.
You may opt out of marketing messages at any time by texting STOP in reply or by using an unsubscribe mechanism provided in a message where available. You may receive a confirmation message after opting out.
If you participate in more than one Mission Workshop messaging program, you may need to opt out of each program separately where permitted by applicable law.

We may change the telephone number or other identifier used for the Mobile Service. If we do, we may notify you as appropriate. Messages sent to a number that is no longer used for the Mobile Service may not be received.
Wireless carriers are not responsible for delayed or undelivered messages.
You are responsible for providing a valid mobile number and for updating your enrollment if your mobile number changes.
To the extent permitted by applicable law, Mission Workshop is not responsible for delayed, failed, or misdirected delivery of messages caused by telecommunications networks, wireless carriers, devices, or circumstances outside our reasonable control.
Our collection and use of personal information in connection with the Mobile Service is governed by our Privacy Policy.
SECTION 8. INTELLECTUAL PROPERTY
The Service and its contents, features, and functionality, including product photography, photographs, images, graphics, illustrations, video, audio, text, product descriptions, designs, logos, trademarks, trade names, website design, software, and other materials made available by Mission Workshop are owned by or licensed to Mission Workshop and are protected by applicable intellectual property laws.
Subject to these Terms, Mission Workshop grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Service for your personal, noncommercial use.
Except as expressly permitted by us in writing or allowed by applicable law, you may not reproduce, copy, modify, distribute, publish, display, transmit, sell, license, create derivative works from, commercially exploit, or otherwise use Mission Workshop content.
Nothing in these Terms grants you ownership of or any other rights in Mission Workshop's trademarks, trade names, logos, product names, designs, or other intellectual property.
SECTION 9. USER CONTENT, REVIEWS, AND SUBMISSIONS
You may have opportunities to submit reviews, photographs, comments, feedback, suggestions, contest entries, ideas, or other materials through the Service or to Mission Workshop ("User Content").
You retain any ownership rights you may have in your User Content.
By submitting User Content to us, you grant Mission Workshop a worldwide, nonexclusive, royalty free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, distribute, and otherwise use that User Content in connection with our business, products, services, marketing, advertising, and promotional activities, subject to applicable law.
You represent that you have the rights necessary to submit the User Content and grant this license.
You may not submit User Content that:

infringes or violates the intellectual property, privacy, publicity, or other rights of another person or entity;

is knowingly false, misleading, defamatory, unlawful, threatening, abusive, obscene, or otherwise prohibited by applicable law;

contains malware or harmful code; or

falsely represents its source or your identity.
We may, but are not obligated to, monitor, edit, refuse, or remove User Content where permitted by law.
We are not responsible for User Content submitted by third parties.
SECTION 10. THIRD PARTY SERVICES, TOOLS, AND LINKS
The Service may provide access to websites, applications, payment providers, social networks, services, content, or tools operated by third parties.
We do not control third party services and are not responsible for their availability, content, security, accuracy, products, services, privacy practices, or other activities.
Your use of third party services may be governed by separate terms and privacy policies established by those third parties.
You should review applicable third party terms and policies before using those services or completing transactions with third parties.
To the extent permitted by law, Mission Workshop is not responsible for losses arising solely from your use of unaffiliated third party websites, products, services, or resources.

Your privacy is important to us.
Our collection, use, disclosure, retention, and other processing of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Our Privacy Policy also describes applicable privacy rights and how eligible individuals may exercise those rights.
Where required by applicable law, we may provide additional notices at or before the point at which personal information is collected.
Please review our Privacy Policy before using the Service or providing personal information to us.
SECTION 12. ERRORS AND INACCURACIES
Occasionally, information on the Service may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability, or other information.
Subject to applicable law, we reserve the right to correct errors, inaccuracies, or omissions and to update information at any time.
If an error affects an order you have already submitted, we may contact you, cancel the affected portion of the order, or take other appropriate action consistent with applicable law.
We do not undertake a general obligation to continuously update information on the Service except where required by law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR FREE.
TO THE FULLEST EXTENT PERMITTED BY LAW, MISSION WORKSHOP DISCLAIMS WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
Any product warranty expressly provided by Mission Workshop separately from these Terms will be governed by the terms of that warranty.
SECTION 15. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MISSION WORKSHOP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE OR PRODUCTS PURCHASED THROUGH THE SERVICE.
THE FOREGOING LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF MISSION WORKSHOP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
SECTION 16. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Mission Workshop and its affiliates, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, and suppliers from claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys' fees arising from or relating to:

your material breach of these Terms;

your unlawful use of the Service;

User Content you submit; or

your violation of the rights of another person or entity.
Your obligations under this Section are subject to any limitations imposed by applicable law.
SECTION 17. SUSPENSION AND TERMINATION
These Terms remain effective while you use the Service.
You may stop using the Service at any time.
We may suspend or terminate your access to all or part of the Service if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, created a security risk, or otherwise misused the Service.
Termination does not affect rights or obligations that accrued before termination. Provisions that by their nature should survive termination will remain effective after termination.
SECTION 18. GOVERNING LAW AND VENUE
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of California, without regard to its conflict of laws principles, except to the extent applicable law requires otherwise.
Subject to any rights you may have under applicable consumer protection law, any judicial proceeding arising out of or relating to these Terms or the Service will be brought in a court of competent jurisdiction located in San Francisco County, California, and each party consents to the jurisdiction of those courts.
Nothing in this Section prevents a consumer from exercising rights that cannot lawfully be waived under the laws applicable to that consumer.
SECTION 19. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by applicable law or severed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
SECTION 20. WAIVER
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
A waiver will be effective only if expressly made by the party granting it.
SECTION 21. ENTIRE AGREEMENT
These Terms, together with the policies and other terms expressly incorporated by reference, constitute the entire agreement between you and Mission Workshop concerning the Service and supersede prior or contemporaneous agreements and communications concerning the subject matter of these Terms.
These Terms do not alter any separate written agreement you may have with Mission Workshop where that agreement expressly provides that its terms control.
SECTION 22. CHANGES TO THE SERVICE
We may modify, suspend, or discontinue all or part of the Service from time to time.
We may also change product offerings, features, functionality, or prices.
To the extent permitted by applicable law, Mission Workshop will not be liable solely because we modify, suspend, or discontinue a feature or portion of the Service.
SECTION 23. CHANGES TO THESE TERMS
We may update these Terms from time to time.
When we make changes, we will post the updated Terms and revise the "Last Updated" date above. Where required by applicable law, we will provide additional notice or obtain consent before material changes become effective.
Your continued use of the Service after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
Changes will not retroactively reduce rights or materially increase obligations where doing so would be prohibited by applicable law.
